Respondent Canadian Imperial Bank of Commerce brought applications to have certain land transfers, relating to properties owned by applicant David Lightfoot, declared null and void.

The Ontario Superior Court of Justice determined that the transfers had violated the Planning Act, R.S.O. 1990, c. P.13. The transfers were declared null and void. The Court of Appeal dismissed Mr. Lightfoot’s appeal.
