On December 20, 2020, the police noticed the applicant, Gloriane Blais, participating in a public demonstration without wearing her face mask correctly. According to the order in council in force at that time, the government allowed persons to gather to protest peacefully, but those persons were required to wear a face mask and to be a distance of two metres from any person, with some exceptions. She then received a statement of offence in which she was alleged to have refused to obey the order to wear a face mask during a gathering of persons who were exercising their right to protest publicly, in violation of the Public Health Act, CQLR, c. S 2.2.

Before the presiding justice of the peace responsible for the management of this case, Gloriane Blais filed motions for further disclosure and for herself and her witnesses to be allowed to proceed by videoconference. These motions were dismissed. Before the same justice, Gloriane Blais filed a motion in unconstitutionality for the Public Health Act to be declared invalid and of no force or effect. This motion was also dismissed. Before the Court of Québec judge responsible for hearing the trial, she was convicted of the offence as charged. The Quebec Superior Court dismissed Ms. Blais’ appeal, no reviewable error had been committed by the presiding justice of the peace in her assessment of the preliminary motions. The Court of Appeal dismissed the application for leave to appeal because all of the grounds raised were untenable and doomed to fail.
