The applicant, Éric Tremblay, applied to receive the Canada recovery benefit (“CRB”). After several weeks of collecting it, his applications were verified. After two reviews, it was found that the applicant was not eligible for the CRB because he had not earned at least $5,000 in employment income or net self employment income as required by the Canada Recovery Benefits Act.

On judicial review, the Federal Court found that the Act permits the reconsideration of applications. Since the impugned decision was not unreasonable, there was no reason to intervene; the application for judicial review was dismissed. The Federal Court of Appeal upheld that decision; the notice of appeal was doomed to fail.
