The applicant is the mother of a child placed under youth protection in Quebec. In February 2025, she unsuccessfully sought leave to appeal from a judgment rendered by the Superior Court, which refused to intervene to set aside a judgment of the Court of Québec at the provisional measures stage. In his analysis, the Superior Court judge found that a judgment rendered in the course of a proceeding by the Court of Québec under the authority of the Youth Protection Act cannot be subject to immediate appeal and that a judgment on the merits was necessary. The Court of Appeal adopted this analysis and found, in turn, that the appeal envisaged by the mother had no reasonable chance of success and did not indicate sufficient interest within the meaning of s. 115 of the Youth Protection Act. It thus denied the mother leave to appeal.
