Summary

The applicant is a self-represented litigant who has commenced actions against a large number of defendants. The nature of his communications with the staff of the Court of King’s Bench of Alberta prompted staff members to refer them to the local administrative justice for action.
The local administrative justice, on his own motion, found that the applicant’s communications with court staff were abusive and wasteful, and issued an order prohibiting him from communicating with the court by electronic means.
The applicant sought to appeal this order, but filed his notice of appeal out of time. A case management officer solicited a motion for an extension of time with a specified deadline. The deadline passed and the appeal was struck. The applicant applied for an extension of time and an order restoring his appeal. A justice of the Court of Appeal found that the applicant formed a timely intention to appeal and that an extension would not prejudice the respondents, but held that those factors were outweighed by a lack of reasonable explanation for the delay and a lack of merit to the proposed appeal. The applicant sought permission to appeal this decision to a full panel of the Court of Appeal. Permission was denied.

The condensed books of the appellant, the respondent and the intervener will be posted here upon receipt of the electronic version, 2 days prior to the scheduled appeal hearing. You may also obtain copies of condensed books by filling out the Request for Court records form or by contacting the Court’s Records Centre either by email at records-dossiers@scc-csc.ca or by telephone at 613‑996‑7933 or at 1‑888‑551‑1185.
