Le demandeur est un plaideur non représenté qui a intenté des actions contre un grand nombre de défendeurs. La nature de ses communications avec le personnel de la Cour du Banc du Roi de l’Alberta a incité les membres du personnel à les transmettre au juge administratif local pour qu’il prenne des mesures.
Le juge administratif local, de sa propre initiative, a conclu que les communications du demandeur avec le personnel du tribunal étaient abusives et inutiles, et a rendu une ordonnance interdisant au demandeur de communiquer avec le tribunal par voie électronique.
Le demandeur a cherché à interjeter appel de cette ordonnance, mais a déposé son avis d’appel hors délai. Un agent de gestion des cas a sollicité une requête en prorogation de délai avec une date limite précise. Le délai est passé et l’appel a été radié. Le demandeur a demandé une prolongation de délai et une ordonnance rétablissant son appel. Une juge de la Cour d’appel a conclu que le demandeur avait eu l’intention d’interjeter appel en temps opportun et qu’une prorogation ne causerait pas de préjudice aux intimés, mais elle a estimé que ces facteurs étaient contrebalancés par l’absence d’explication raisonnable du retard et l’absence de fondement de l’appel proposé. Le demandeur a demandé la permission d’en appeler de cette décision devant la Cour d’appel siégeant au complet. La permission a été refusée.
