The respondent brought a motion for a permanent or temporary stay of proceedings arguing the action was an abuse of process and a duplicate pleading because the factual allegations and claims against it were a replication of another action commenced against it on December 2023. The case stems from actions commenced by the applicant alleging misuse of intellectual property for extending the shelf-life of meat products.

The motion judge ordered a permanent stay. The Court of Appeal dismissed the appeal.
