This case challenges a finding of liability for misfeasance in public office. The trial judge found that two British Columbia government representatives unlawfully denied permit applications made in support of a proposed hydroelectric project. The judge awarded more than $10 million in damages.

The Court of Appeal allowed the appeal, set aside the trial judgment and dismissed the civil claim
