Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
The Administrative Labour Tribunal found that a settlement agreement and transaction had been concluded between an employee and employer, and it dismissed the related proceedings. The tribunal did not accept the employee’s evidence that she either did not agree to the settlement, or that she had been forced to sign it.
The tribunal dismissed the employee’s application for review or revocation of its decision. The Superior Court dismissed the employee’s applications for judicial review, and the Court of Appeal dismissed the employee’s application for leave to appeal.
Lower court rulings
Existence of transaction recognized. Proceedings dismissed.
Application for review or revocation dismissed.
Applications for judicial review dismissed with costs.
Application for leave to appeal dismissed with costs.
