Gabriela Sefcikova and Kamil Sefcik were served with a notice to end their tenancy for the landlords’ use of the property. They vacated the property in accordance with the notice. Later, they commenced an action alleging that the landlords had not occupied the property within a reasonable period after the effective date of notice, as required by the Residential Tenancy Act. S.B.C. 2002, c. 78.

The action was dismissed following summary trial. An appeal to the Court of Appeal for British Columbia was dismissed.
