Summary

The applicant, Mr. Poitras, alleges that he was subjected to harassment and received an unfair evaluation from his supervising physician during his medical studies and clinical internship at the respondent university (the “institution”). He sought access to the entirety of his university record dating back to 2013, asserting that these documents were necessary to support his action against the institution and 28 other defendants. The Commission d’accès à l’information du Québec granted Mr. Poitras’ requests for review in part and ordered the institution to disclose additional portions of the requested records within a specified timeframe. The Court of Quebec allowed the institution’s appeal in part, set aside the decision of the Commission in part, ordered that the matter be returned to the Commission, dismissed Mr. Poitras’ incidental appeal, and awarded costs in favour of the institution. Mr. Poitras sought to appeal this decision, but the Court of Appeal dismissed his appeal for want of jurisdiction in accordance with section 154 of the Act respecting Access to documents held by public bodies and the Protection of personal information.
