Kirk Norbert Loeffler (hereafter, “Kirk”) passed away in November 2014. At the time of his death, he had been in a relationship with applicant Kathryn Louise Shukin (hereafter, “Kathryn”).

After Kirk’s death, Kathryn commenced proceedings seeking, among other things, a division of property pursuant to The Family Property Act, S.S. 1997, c. F-6.3 on the basis that she and Kirk had been spouses as defined in that Act. A trial was held to determine whether Kathryn had been Kirk’s spouse.

The trial judge found that Kathryn had not been Kirk’s spouse under The Family Property Act. The Court of Appeal for Saskatchewan dismissed Kathryn’s appeal.
