The respondent, the Collège des médecins du Québec, charged the applicant, Annie Juneau, a naturopath, with the commission of certain regulatory offences: acting in such a way as to lead to the belief that she was authorized to engage in acts reserved to members of the Collège (count 1) and unlawfully engaging in professional activities reserved to members of the Collège (counts 2, 3 and 4) — that is, diagnosing illnesses, determining medical treatment and prescribing medications and other substances — despite not holding a valid permit from the Collège and not being entered on the roll of the Collège, contrary to s. 31 of the Medical Act, CQLR, c. M-9.
The trial judge found Ms. Juneau guilty of the four offences. Her appeal from the decision was dismissed by the Quebec Superior Court. After granting leave to appeal for counts 2, 3 and 4, the Court of Appeal dismissed a subsequent appeal.
