This case arises in the context of divorce proceedings involving minor children. The Superior Court dismissed an application for the review of a parenting time order on the grounds that the applicant had not demonstrated the existence of a sufficient material change and that the children’s best interests would not militate in favour of a variation in the terms of the parenting time. The Superior Court also declared the application abusive and exercised its discretion to take sanctions that it considered appropriate in the context of the history of the case by, in particular, ordering the applicant to pay punitive damages and by ordering that any new judicial application by the applicant against the respondent be sent to the coordinating judge of the district concerned. The Court of Appeal dismissed the motion for leave to appeal nunc pro tunc as well as the applications for an extension of time in which to appeal and for leave to appeal, finding that the notice of appeal had been filed out of time and that the applicant had not met the conditions required to obtain leave to appeal.
