The mother and the father are former spouses who have a young child and separated in 2020. Their protracted and high conflict family law proceedings culminated in a May 2024 trial judgment, where various custody and parenting orders were made in the mother’s favour. Following the trial, the father brought numerous unsuccessful motions in the Superior Court and the Court of Appeal and failed to comply with various orders from those courts. A panel of the Court of Appeal allowed the mother’s motion to quash the father’s appeal of the May 2024 trial judgment, noting the father’s conduct was frivolous and vexatious and that this one of the “clearest of cases” justifying the quashing of an appeal as set out in s. 134(3) of the Courts of Justice Act, R.S.O. 1990, c. C.43.
