The applicant, Mr. Carby-Samuels, has an underlying matter against the respondents before the Quebec Human Rights Tribunal (QHRT). He has initiated a number of proceedings relating to the underlying QHRT case before the Superior Court of Quebec, and has attempted to appeal decisions of both that court and the QHRT before the Court of Appeal of Quebec and the Supreme Court of Canada. In the context of this litigation, the respondents brought an application before the Superior Court to have the applicant declared a vexatious litigant. The applicant applied to the Court of Appeal for an order preventing the Superior Court from ruling on the vexatious litigant application. The Court of Appeal dismissed the motion.
