Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
Mr. Qureshi was charged with firearms offences. The Ontario Court of Justice dismissed an application to stay proceedings for unreasonable delay in breach of s. 11(b) of the Charter of Rights and Freedoms. Mr. Qureshi was convicted. The Court of Appeal disagreed with the attribution of some delay as defence delay. It recalculated net delay as exceeding the applicable presumptive ceiling. It overturned the convictions and granted a stay of proceedings.
