Keywords

Family law — Custody — Best interests of the child — Vexatious litigant — Whether a judge should respect the explicit terms of a court order — Whether a court’s failure to apply settled jurisprudence is a breach of the principles of natural justice and a reversible error — Whether Canadian courts can depart from the statutory intent that vexatious declarations should be based and made about the proceeding and not the litigant — Whether the trial judge acted outside her authority — Whether the courts below ignored the best interests of the children.

Summary

Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.

The parties are the parents of two children. The father sought to appeal in interim parenting order imposed by a case management judge. The father has been involved in a great deal of litigation across a variety of subjects and has been declared to be a vexatious litigant by way of an order of the Alberta Court of King’s Bench. Permission to appeal to the Court of Appeal was not granted.
