The United States, represented by the Attorney General of Canada, seeks extradition of the applicant to stand trial on drug trafficking charges. The case against the applicant presented in the Record of the Case is that he trafficked in illicit drugs through an anonymous marketplace called Silk Road that operated from around January 2011 until early October 2013, when it was shut down by U.S. authorities. The trafficking took place through an account named MarijuanaIsMyMuse. Drugs were paid for on Silk Road by Bitcoin. Following a committal hearing conducted pursuant to s. 24(1) of the Extradition Act, S.C. 1999, c. 18, the extradition judge refused extradition and discharged the applicant. The Court of Appeal allowed the appeal, set aside the discharge order, ordered the applicant to be committed for extradition to the U.S.A.
Lower court rulings
Extradition refused, discharge order granted
Appeal allowed: discharge order set aside, applicant ordered to be committed for extradition to the U.S.A.
